Brian Davis represents employers and individuals in
labor and employment law matters, including litigation
of wrongful discharge, discrimination and retaliation
claims. Brian was licensed to practice in 1992, after
graduating first in his law school class.
Before law school, Brian spent 5 years with the Texas
subsidiary of one of the southwest’s largest
savings and loan associations, where he was the Assistant
Vice President for Administration and Operations. He was first trained as a
commercial trial lawyer, before figuring out that
employment work was much more interesting.
Brian has hands-on experience in a wide variety of
employment and labor matters, including the
prosecution and defense of discrimination claims
under Title VII of the Civil Rights Act of 1986 and
the Texas Commission on Human Rights Act.
Brian has also been appointed to represent state prison
inmates in federal First Amendment and religious freedom
litigation. He thoroughly enjoyed the time he spent
inside the Texas prison system, and learned that prison
chaplains have an extraordinarily difficult job.
Brian also advises clients with issues arising from
mass layoffs and plant closings under the Worker Adjustment
and Retraining Notification Act, the National Labor
Relations Act and the North American Free Trade Agreement.
He has extensive experience with major employee fraud
and embezzlement investigations and has worked with
local and state authorities, as well as the Federal
Bureau of Investigation, in litigation, forensic accounting
and asset recovery. He personally knows a 250 pound
FBI Special Agent whose name is – no kidding
– “Tiny.”
Brian represents employers and executives in planning,
interpreting and litigating executive compensation
plans and contract terms. He also advises clients
with respect to the Family Medical Leave Act, the
Texas Payday Law and issues arising under the Americans
with Disabilities Act, and the Age Discrimination
in Employment Act.
He has represented clients in proceedings in state
and federal courts all over Texas, and in administrative
proceedings with the U.S. Equal Employment Opportunity
Commission, the U.S. Department of Labor, the U.S.
Occupational Safety and Health Commission and the
Texas Workforce Commission.
Brian is actively interested in employee and workplace
privacy issues such as drug, alcohol and disease testing.
Brian was born in Russell, Kansas, the hometown of
former U.S. Senator Bob Dole, but got to Texas just
as soon as he could. He was raised in Midland, Texas,
where Brian’s father was the president just
before President George W. Bush (of the Midland Little
League Baseball organization). Brian lives in New
Braunfels, Texas.
